Shamik S. Sanjanwala

Partner | Head Delhi Office

Shamik is a Partner with the firm and heads the Delhi office. He has been practising at the bar for the last 25 years. He completed his Law in 1998, from the National Law School, Bangalore, and thereafter did his Masters in Corporate & Commercial Law from the London School of Economics. He has put in 20 years of active practice in Delhi.

He handles a wide array of civil and commercial litigation disputes, in the Supreme Court of India, Delhi High Court and Tribunals. He works extensively, in the area of domestic and international arbitrations and handles Construction & Engineering related arbitrations. He is also an Advocate-on-Record of the Supreme Court.

Shamik is a Qualified Solicitor of the Courts of England & Wales. He has practised in one of the top international commercial litigation law firms, Herbert Smith, in London. Over the years he has gathered substantial experience in handling domestic and international arbitrations.

Shamik is also appointed as an “A” panel Senior Standing Counsel for the Union of India, in the Supreme Court, and appears as a Counsel in the Supreme Court on behalf of the State of Gujarat.

Some of the cases and clients that Shamik has acted for are as follows:

• Acted in civil and commercial disputes, before the Supreme Court and Delhi High Court in diverse areas ranging from Contractual disputes; Corporate & Commercial disputes; Intellectual Property disputes; Indirect tax matters; Labour Law matters, Land Acquisition & Town Planning matters, Property disputes and others.

• Acted for Fujitsu Japan in an international arbitration against an Indian State-owned telecom major, Mahanagar Telecom Nigam Limited (MTNL).

• Acted for Walter Bau, a German multinational, in a claim made against an Indian company in an international arbitration proceeding, and in the challenge before the Supreme Court to the constitution of the arbitral tribunal.

• Acted for an Indian Power Company in an international arbitration against a German Company. 

• Acted for JMC Projects Ltd., in several arbitration proceedings concerning infrastructure project contracts entered into with the National Highway Authority of India.

• Acted for Sadbhav Engineering Limited in arbitrations pertaining to infrastructure contracts entered with the National Highway Authority of India and other government departments.

• Acted for Videocon Group in an arbitration and challenge to a domestic arbitral award before the Delhi High Court, in relation to a power project. 

• Acted for Kalpataru group, a major Power & Construction company, in arbitration proceedings involving infrastructure contracts with the Government

• Acted for Reliance Industries in litigations before the Supreme Court of India

• Acted for SAI Consulting (part of SYSTRA group), in the Delhi High Court, against a debarment order passed against it in a government contract and in a challenge to the same in arbitration proceedings. 

• Acted for Hari OM Engineering, an infrastructure company, in the Delhi High Court, regarding a debarment order passed against it by the Military Engineering Services, and in Arbitration disputes against Military Engineer Services.

• Acted for Gujarat based Oil, Gas & Fertilizer companies, in their dispute before the Supreme Court, in relation to the $60 million annual increase of price of Re-Gasified Liquid Natural Gas, by Union of India & Petronet LNG.

• Acted for Amul Cooperative Society, India´s leading milk producing and marketing federation, in the Supreme Court, in a litigation arising out of a no confidence motion passed against its Chairman.

• Acted in a litigation before the Supreme Court on behalf of a group of landholders pertaining to their right to demand release of a large parcel of land, around 200 acres, in Surat from reservation/acquisition by the Government of Gujarat.

• Acted for an Indian real estate major, Vatika Group, in relation to its dispute with the Government on payment of service tax for renting of commercial property.

• Acted for Oberoi group, a large Indian Hotel group, regarding cancellation of allotment of land by the government for the construction of a hotel.

• Acted for an Indian mining company in a claim for royalty made against it for its mining activities in the State of Rajasthan.

• Acted for La-Reunion Arienne and Air France, before the Consumer Forum, in a claim for compensation made against it. 

• Acted for Nike before the MRTP Commission, in its dispute regarding their marketing rights over clothing & apparel of sportsmen.

• Acted for the Indian Government’s Television broadcast authority in an arbitration claim made against it by a large media company.
